mauet fundamentals of trial techniques: Perspectives on Socially Shared Cognition Lauren B. Resnick, John M. Levine, Stephanie D. Teasley, 1991-01-01 Aims to undo this figure-ground relationship between cognitive and social processes. The chapters in Part One, by developmental, social, and educational psychologists and an anthropologist, explore the role of the immediate social situation in cognition, offering challenges from the mild to the deeply unsettling to psychologists' traditional assumptions about cognition, competence, and performance. In Part Two, chapters by a psychologist/anthropologist explore from a linguistic perspective the various and often hidden ways in which the social permeates thinking, especially by shaping the forms of reasoning and language use available to members of a community. Part Three contains three chapters by psycholinguists, a sociologist, and social psychologists that examine the way language functions in face-to-face communication. Part Four, in chapters by an anthropologist, developmental psychologists, and social psychologists, examines the sources, individual and social, of shared cultural knowledge. Part Five contains chapters by an anthropologist and by social and cognitive psychologists examining the structure and processes of cognitive collaboration in work situations. In Part Six, several chapters by developmental psychologists consider the individual in sociocognitive activity. (PsycINFO Database Record (c) 2004 APA, all rights reserved).

mauet fundamentals of trial techniques: Modern Trial Advocacy Steven Lubet, Cynthia Tape, Julie Rosenthal, Lisa Talbot, 2019-07-28 Now in its fourth edition, Modern Trial Advocacy: Canada is the first and last word in Canadian trial practice. This classic handbook, published by the National Institute for Trial Advocacy, gives practitioners a detailed road map for conducting a trial. Expanding on the original text written by Steven Lubet for an American audience, experienced Toronto trial lawyers Cynthia Tape and Julie Rosenthal guide the beginning advocate in developing a winning case theory through all phases of trial. They explain how to present a case as a story – and powerfully and persuasively tell that story to the jury. Modern Trial Advocacy: Canada provides not only Canadian case law and statutes, but also valuable insight into the specific elements of Canadian litigation practice as itpresents a realistic and contemporary approach to learning and developing trial advocacy skills. This book offers a sophisticated, theory-driven approach to advocacy training that distinguishes it from other books in the field. The fourth edition has been updated with current citations to case law, statutes, and rules and the latest “best practices” for using technology in the courtroom.
mauet fundamentals of trial techniques: Day in Court Francis L. Wellman, 2019-07-23 THIS is in no sense a law book. The general reader cares little for lawyers and their dry rules of law, or the prosaic forms of practice and procedure in our courts. Everybody, however, is interested in the drama of a great trial, where the property, reputation, liberty, or life of a human being is often at stake. This has been strikingly exemplified recently by the great interest taken in the trial of Madame Steinheil in France, accounts of which were published in all the leading newspapers of the world. All our leading newspapers, nowadays, publish detailed accounts of every occurrence of general interest long before such matters reach the stage of litigation, and the whole reading public thereby becomes a jury to weigh each step of the evidence and render their verdict upon its truth or falsity. That this is true even of quasi-scientific questions was well illustrated by the intense public interest in the newspaper controversy as to Dr. Cook’s alleged discovery of the North Pole, or his ascent of Mt. McKinley. The general public, therefore, should naturally be interested in the correct methods of sifting out the truth of any controversy or disputed question of fact, in which they may for any reason become interested. The purpose of this work is to give the general reader, and young men who desire to become successful advocates, some practical knowledge of the arts of great advocates in eliciting the truth; to indicate also the methods by which they charm and convince both court and jury, and win them over to their side of the controversy.—Francis L. Wellman

mauet fundamentals of trial techniques: Rediscovering Rhetoric Justin T. Gleeson, Ruth C. A. Higgins, 2008 Rhetoric is ubiquitous in modern discourse: from arguments delivered in the High Court, to advertisements disseminated in the high street. For the legal and political advocate, persuasion is also a professional technique that must be perfected properly to practise each art. In contrast with the classical era and the middle ages, in which grammar, rhetoric and dialectic were basic features of all education, modern curricula almost entirely neglect any theoretical study of the methods of rhetoric. Rediscovering Rhetoric re-introduces to modern practitioners and students a grasp of the speeches, writings and methodologies of the great classical scholars of rhetoric. Part 1 - Law and Language in the Greco-Roman Tradition provides a contextualised introduction to significant theorists of rhetoric in the classical period, and consists of four chapters written by practising barristers and a current Justice of the Federal Court of Australia. Part 2 - The Practice of Persuasion comprises essays by practitioners distinguished in their pursuit of legal persuasion - one former and two current Justices of the High Court of Australia - illuminating their experiences of argument from the perspective of both bench and bar. Part 3 - The Politics of Persuasion performs a similar function to Part 2, in the related domain of politics. It includes a chapter by Graham Freudenberg, former speechwriter for Gough Whitlam and others. Together the three parts provide a unique inter-disciplinary perspective on the theory and practice of legal and political persuasion. Published in association with the NSW Bar Association.

mauet fundamentals of trial techniques: Gender Trials Jennifer L. Pierce, 1996-02-15 This engaging ethnography examines the gendered nature of today's large corporate law firms. Although increasing numbers of women have become lawyers in the past decade, Jennifer Pierce discovers that the double standards and sexist attitudes of legal bureaucracies are a continuing problem for women lawyers and paralegals. Working as a paralegal, Pierce did ethnographic research in two law offices, and her depiction of the legal world is quite unlike the glamorized version seen on television. Pierce tellingly portrays the dilemma that female attorneys face: a woman using tough, aggressive tactics—the ideal combative litigator—is often regarded as brash or even obnoxious by her male colleagues. Yet any lack of toughness would mark her as ineffective. Women paralegals also face a double bind in corporate law firms. While lawyers depend on paralegals for important work, they also expect these women—for most paralegals are women—to nurture them and affirm their superior status in the office hierarchy. Paralegals who mother their bosses experience increasing personal exploitation, while those who do not face criticism and professional sanction. Male paralegals, Pierce finds, do not encounter the same difficulties that female paralegals do. Pierce argues that this gendered division of labor benefits men politically, economically, and personally. However, she finds that women lawyers and paralegals develop creative strategies for resisting and disrupting the male-dominated status quo. Her lively narrative and well-argued analysis will be welcomed by anyone interested in today's gender politics and business culture.
